@Shakester71 They're very inconsistent with their rules. If Sway DQed, they did it too late and again, inconsistent. Corey Clark from Season 2 wasn't eliminated, he was flat out disqualified for his legal troubles.

This guy doesn't even make it past the Top 24 and guys like Lee DeWyze and Kris Allen win??? Something is wrong with the show!

@Mr1131988 I think its kind of hard to distinguish contractual issues. Locally, Drop N. Harmony songs were being played on the radio and even reached certain levels in terms of top hits of the week. I think there a many loopholes in the AI regulations that many singers try to get past, but its harder when you're the lead singer of a group whose songs were being played on the radio. Then again..who knows right? There are too many politics going on with that show as is.

@Shakester71 Yeah I'm a fan of all the groups he's been a part of. I hope that is the real reason he got booted out but then again it's all about the votes, not so much talent. So even if you rid yourself of that record deal, as long as you recorded and released music once before then you are automatically ineligible to audition? Coz Sway's 6th Day buddies said he was no longer signed by the time he joined Idol.

@Mr1131988 there was a reason that he got eliminated. they'll never come out and say it but he was pretty much disqualified. the rules state that a contestant could of had a previous contract with a record company, but if their music is published, then they're not eligible to audition for American Idol. Sway Penala was part of a group called Drop N' Harmony which was under Classifed Records and they produced a few albums that were sold.

listening to this again for the first time since i saw it live, he sounds so hyped that at times it wasn't clean. maybe he was setting up for the ridiculously awesome high note.

Sway Penala's elimination is the reason I never watch American Idol consitently anymore and is also why the show to me, isn't a credible place to find a talented superstar.
