  • and i'm not a good enough singer that I have very many people that notice me anyways, I will probably take off alot of my songs i've done just so I don't get in trouble.. thanks for the response. good day..

  • @steverc1000 Steve, the point is not to scare you enough to take your videos down. The worst that would happen is that Youtube would make you take a video down if the copyright owner protested. They might let you leave it up but ads would be placed on it. Youtube would only cancel your channel after they have warned you a couple of times. No company is going to come after you for putting it on Youtube.

  • @singerandasong The main purpose of this video is to help artists that have a substantial investment of time and/or money in their Youtube channel and are afraid of having their channel canceled for posting cover songs. These artists are usually also trying to promote original songs and trying to get record deals and using Youtube as a means of promoting themselves.

  • @kissing88 You are right the law is more about interpretation and application than what the law actually says. However, I thing that even though the interpretation is pretty strict it is the one that Youtube and the courts have used, especially in light of the Millineum Copyright Act.

  • @singerandasong What you must understand about the law (and I'm sure you do) that it is open to interpretation. Your personal interpretation of the law is one of the strictest ways it can be interpreted, which is not necessarily always the best way.

  • what if i'm not and don't want any funds from my videos, I just post them to share with whom ever wants to watch and listen..because that is all i'm doing..just wondering..

  • @singerandasong YouTube will take down ANYTHING that gets claimed as Intellectual Property. I could claim this very video as my I.P. and YT will take it down! That's how flawed the DMCA is. Back to the subject: I agree that a lot of covers are (in my opinion) just plain infringing because they lack TRANSFORMATIVE effort,but by no means you can put all covers in YouTube in that same category...

  • @destroyOCTS Some people feel that Fair Use should cover this but I believe what I wrote is the opinion expressed by the courts and which Youtube uses. That is why when a copyright owner protests the use of a song Youtube will take it down. The exception is that some copyright owners allow the videos to stay posted as long as they receive revenue from ads posted with the video. This is one reason some covers remain and others do not. Also some copyright owners don't complain.
