Well for a start, rubato means interpreting a melody freely, normally in the absence of any other instrument keeping time. Here you have 1. a drum machine (yes, Drum machines play clave different to human beings) playing 3/2 clave, while the melody and conga pattern suggests it should be 2/3... 2. A rhythm resembling the cascara pattern of the timbales, programmed to play in 2/3, which is musical nonsense,...
It's called rubato and it's still in clave timing even if it's not claves playing the rythm, also, you should wait until after the intro, the actual song starts around 1:54
And it reverses after 6:30 or so, on what is really the outro, shines battle?
