[Background]

Verapat Pariyawong, then a junior law student at Chulalongkorn University, appeared in the final round of the Young Thai IP Law Ambassador intellectual property law moot court competition, held at the Central Intellectual Property and International Trade Court of Thailand, in November 2006. The competition was organized by British Council Thailand in partnership with the Central Intellectual Property and International Trade Court, Truevision and BIOTEC.

Verapat, along with his friend, Kullarat Phongsathaporn, argued for Plaintiff, Manchester United Public Limited Company in a dispute concerning plaintiff's trademark. The Defendant was a registered business entity "Man U Pub and Restaurant", whose reputation in the case also involved drugs and prostitutes. "Man U" was not a registered trademark in Thailand.

Counsel for Plaintiff submitted 4 legal arguments in relations to the laws of Thailand:
1. Passing off (Section 46 of the Trademark Act)
2. Dilution
3. Unfair Competition
4. Infringement of trade name (Civil and Commercial Code Section 18)

Plaintiff requested the Court to order the defendant to stop the name and mark "Man U" and to pay compensation of 12 million Baht.
