According to Judicial theory that failure to answer the question, or answer in a way unrelated to the question, gives a right to determine the results that can be detrimental to the person being questioned, a bias. Example, a suspect being questioned about a robbery answers "I didn't do it on Tuesday" is not an answer, and answered some unspoken question, we start to find guilt to the detriment of the suspect. The problem is to claim the Fifth Amendment means no testimony, otherwise, answer.

@MrGrevy - I thought Elena answered more questions than she needed to. She does come from the East Coast intellectual world. It was her humor that carried her through to confirmation. I was probably thinking of conservative Republicans such as John Roberts when I wrote the above. He was by far the least communicative of all nominees when he sailed through confirmation. I was very proud of Barack Obama and other liberal Senators for voting against him and trying to press for clear answers.

@bigdogphoto - Coburn is part of the The Family on C Street, their secrecy is more concern to me and their very existence, than the questions Coburn is asking of Kagan, Coburn needs to be investigated.
