The 10th Amendment states, "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people." The only reference to Habeas Corpus is, "The Privilege of Habeas Corpus shall not be suspended, unless when in cases of rebellion or invasion the public safety may require it." No delegation of power to suspend this writ is stated and not a power of the President's. Any statute blocking this writ is illegal
The American Civil War is HARDLY the same thing as our intrusion into Iraq's civil war! They didn't even ASK for our "help"(as in the Korean & Vietnamese conflicts). HOW is the suspension of OUR civil liberties in ANY WAY pertinent???
