  • It is a mandate. They're forcing people to buy health insurance. It really is that simple. You can try and use political jargon to fancy it up, but you're forcing people to purchase a service.

  • Health insurance is attached to an individual - not to a geographic location. The fact that people have the right to interstate travel means that health insurance is an interstate economic activity. And this isn't a mandate, it's a tax incentive - and there is no doubt that congress has the power to tax.
