Watch how some people who appear completely sober, only having a few drinks is shown to be way over the legal limit - while others who had 9 or more drinks and were clearly drunk almost passed the test! Watch this video! It's not every day that you can see the actual machine the officers use to try to determine your alcohol content. The dude says it's an unreliable piece of equipment that should NEVER be trusted. You do NOT have to take this test. You are already under arrest, so even if you blow under they will not let you go. Stay polite and calm but exercise your right to not offer additional evidence against yourself.

Taking the breath test is one of the biggest mistakes you can make if you are under suspicion for dwi. All you're doing is giving the state more ammunition to fire at you in trial. It may not matter if you look perfectly fine on a video, if the jury hears you blew over a .08, that could be enough to convict you. "But what if I blow under a .08?" First of all, the chances of that are very unlikely. Second, I have represented numerous citizens charged with DWI even when they blew below a .08.
