הקורס עוסק בהיבטים היסטוריים, פוליטיים, חברתיים וחוקתיים של הגדרתה של מדינת ישראל כמדינה יהודית ודמוקרטית. הוא דן במשמעות של המושגים היסודיים של 'מדינה דמוקרטית' ו'מדינה יהודית' ובטענות כי מדינת ישראל אינה יכולה להיות הן יהודית הן דמוקרטית, וזאת משתי נקודות מבט -- זו של הסכסוך היהודי-ערבי וזו של הסכסוך הפנים יהודי בין תפיסות דתיות לבין תפיסות לאומיות-תרבותיות של יהודיות. הקורס מציג תפיסה של ישראל כמדינת הלאום של העם היהודי, ועורך השוואה בין ההסדרים הנוהגים בה לבין ההסדרים הנוהגים במדינות-לאום מודרניות אחרות. כמו כן, נבחנות סוגיות מיוחדות כגון קרקעות, אזרחות, שבות ושיבה, דתות ומדינה, חינוך, שוויון זכויות ושוויון חובות ושאלת הביטוי החוקתי של זהות המדינה.

The course deals with the definition of Israel as a Jewish and Democratic state from historical, political, social and constitutional perspectives. It analyzes the concepts 'a Democratic state' and 'a Jewish state'. It examines the claim that the state of Israel cannot be both Jewish and Democratic from two perspectives: that of the Jewish-Arab conflict, and that of the internal Jewish conflict concerning religious vs. ethnic and cultural conceptions of Judaism. The course offers a conception of Israel as the nation-state of Jews and compares its arrangements to those prevailing in other modern nation-states. It also examines issues such as land ownership, citizenship, the Law of Return and the Palestinian Right of Return, education, equality of rights and duties, and the identity of the state and its place in a constitution.
