Couple Arrested for Refusing to Pay Tip!

It is the job of law enforcement professionals to determine the viability of a case against its citizens. The Bethlahem, PA Police apparently have a policy that when a 9-1-1 call is made, an arrest must be made.

Pope and John Wagner did not walk out on their dinner at the LeHigh Pub. They received such poor service, that they refused to pay the "mandatory gratuity" levied on parties of 6 or more. They paid all other tax and charges for their party's food, but informed Lehigh staff that they would fore go tipping their server, since they got their own beverages, silverware, and napkins (and waited an hour for thei food).

Nevertheless, the pub called the Bethlehem Police, and the Wagner's were promptly arrested on theft charges for the $16 they refused to pay. The charges were finally dropped by the pub, on recommendation of the District Attorney. Report found at

gartuity. a gift of money, over and above payment for service.. To define it is a gift a gift. To requier a gift In itself is a contradiction. first the tip should never be mandentory! suggest yes and mybe a persent too if the sevice was adiquet. The contract between the patren and the restaurant, custamary is to provide eatable food and adiquit sevice befor payment is made! if these requierments are met then payment is made. If not payment is to be determined accordingly. call 911 is a joke

@alandalus1 .. Tips are not always optional. If you have more than a certain number of people in your party it is usually mandatory and is added in. Also, a lot of places add the tip in when you order food to go, as well as when you order food to be delivered. Pizza Hut, Dominoes, Etc.. are real bad about it. Next time you order from them check your receipt real carefully.. it is usually written in as a surcharge, which means you double tip.

If a gratuity is mandatory on large parties (which they usually are, and it is usually posted) then that added into the bill becomes part of the bill. If they didn't pay it, then they did not pay the complete bill and therefore ARE guilty of theft. The smart thing for the couple to do would have been to pay the tip and consider it a lesson learned and take their business somewhere else in the future. The Police (even though they may not have like it) did the correct thing.

I hope they sued the bar and put them out of business. I would support any businessperson who gave me good service but anyone who calls the cops over a bullshit "mandatory tip" after giving horrible service doesn't deserve to earn a living.
