Once you have filed a Chapter 7 or Chapter 13 bankruptcy, the next concern is usually being prepared for the hearing - which is technically called the meeting of creditors. I call it a hearing, because that's what it is. It is usually at a federal courthouse. You will be put under oath and asked a list of questions. This video is not about what questions will be asked. That's another whole topic.

It's called the meeting of creditors because all the creditors are invited. Please know, however, that the creditors usually don't come. Unless the creditor has a specific question, being there has no benefit to the creditor.

This video is only about what to bring to the hearing. Those items are a government photo ID, proof of your social security number, bank statements for all accounts which were open on the day of filing, and the most recent pay stub from any and all employment. In addition to these items, the trustee may request additional materials.

Sometimes the trustee will not only request additional items but will also ask that everything be scanned and sent electronically days or weeks in advance of the meeting of creditors. There is a web site which some of the trustees are using to which the materials they request can be uploaded. At the time of this writing, only about one-third of the trustees in Minnesota are using that procedure.

It is important to have an experienced attorney who can advise you as to what will be required in your particular case with your particular trustee. This is not something that you should be trying to do on your own without a lawyer.

This video is for general information purposes only, is not legal advice, and does not create an attorney-client relationship. It is recommended that you consult the attorney of your choice concerning the details of your case.
