I call on the Discovery Institute to serve me a DMCA take down notice for this video, as they claim have claimed that the contents of this video infringe their copyright and/or that they are the party with authorisation to act in this case of "copyright infringement"...

The Discovery Institute (hereinafter "DICS") originally issued a DMCA take down notice against this video in order to silence DonExodus2's criticisms of Luskin (and the DICS).

Such use of the DMCA is illegal. I find such behaviour absolutely DESPICABLE. The misuse of laws in this way to gag free speech, rather than some other form of civilised rebuttal, tells you a little something about the DICS.

The issuing of a DMCA takedown notice is illegal here because:
1) The Discovery Institute (DICS) do not own the rights to the footage used in this video. Fox News does.
2) The footage is clearly used under section 107 of the copyright act (which includes "...criticism, comment, ... teaching, ... research" etc).

The DMCA take down notice is a claim by the person issuing it that they own the copyright, and/or that their copyright has been infringed. It is illegal to file a DMCA take down notice against material for which you do not have a valid copyright claim.

Under section 512 of the DMCA it is possible to sue the DICS for this, and they are certainly not getting away with it. In order to file the infringement notice the filer must state under the penalty of perjury that they are the person authorised to act in taking down the video, and that indeed this is a serious and valid case of copyright infringement.

I once again call on the Discovery Institute (DICS) to serve me a DMCA take down notice for this video.

The DICS need to learn a lesson from the case of Scientology vs The Internet. If you silence someone in this way, you will draw MASSIVE negative attention. Taking down one video will make many more spring up in its place. You can't win an argument by trying to silence the opposition. It's disturbing/boggling to see the DICS trying to do this because the community response in the proliferation of the video is very strong. Further reading: see Wikipedia on the "Streisand effect".

Hackel's embryos?? Lol! I love when a right-winger brings that crap up. What "biology textbooks" still use it?? Name one, you douchebag! I took Biology in 10th grade, and I didn't see any "Haeckel's embryos."

Most evolutionists don't even TALK about embryos as a "reason" for evolution. They talk about stuff that has a lot more evidence. He's attacking something that has nothing to do with the debate.
