QUESNEL and others, including Does 30-100, deliberately took steps to break the ALPA union and lock out the unionized pilots, co-pilots, and engineers, within 9 months of CNF and EWA, signing a Collective Bargaining Agreement with the Air Line Pilots Association, Plaintiff's bargaining agent. Defendant QUESNEL's office and principal place of business is in San Mateo County, California.

QUESNEL sits as the head of the board of directors of EWA. QUESNEL and Does 31-60 ordered the violation of the California Labor Code Sections 922 and 923 that prohibit retaliation for union activities.

12. QUESNEL supervised and directed the disposition and diversion of funds and

assets of EWA. The income, and money from sale of EWA assets, were wrongfully diverted and/or redistributed to other CNF entities during the relevant period, 1999-2002.

QUENEL and CNF, and does 31-100, broke the union and shifted the airline's assets to other entities under the CNF umbrella.

QUESNEL orchestrated the wrongful termination and/or wrongful furlough of Plaintiffs herein, to void the ALPA union contract with EWA; organized and orchestrated the diversion of EMERY and EMERY forwarded freight from EWA to other airlines, named as Doe Defendants, in furtherance of a "scheme" to put EWA's pilots out of work and break the union.

the CEO of CNF, and a member of the Board of Directors of CNF's wholly owned subsidiary, EWA. QUESNEL is, and was, the principal conspirator to break the EWA pilots when they unionized through the AIR LINE PILOTS ASSOCIATION, (ALPA). ALPA successfully negotiated a new contract with EWA and CNF for the plaintiffs herein. QUESNEL, CNF, EMERY and EWA caused EWA to terminate day to day operations by EWA on August 13, 2001, after draining EWA of assets and money.
