Beth Mason, Family solicitor at Fisher Meredith LLP, talks about importance of pre and post nuptial agreements in modern marriages.
Pre nuptial agreements, similarly to pre civil partnership agreements, set out what should happen to a couple's assets and income in the event their marriage or civil partnership breaks down. Post nuptial agreements deal with the same issues but are taken out during marriage or civil partnership rather than before.
These agreements are particularly useful in cases of second marriages or civil partnerships where both parties have assets from their previous relationship and often children from those relationships who they wish to be able to leave their inheritance to.
It is important to take legal advice if you are considering signing this agreement. If not properly drafted, pre and post nuptial or civil partnership agreements will not be upheld.
