2. The persons on which they were used are terrorists.

3. This is not a criminal justice situation, this is war.  There is no need to 'charge' a combatant in order to detain them. Combatants are not suspects. Do not confuse two very distinct situations.

You family is on an international flight. A terrorist is in custody with information on this flight that will prevent the bombing of this flight. Would you think it acceptable to "Waterboard" this terrorist to save the lives of your family and others? OR, do you feel it's O.K. to cut the head off of someone with a dull butter knife while filming it.
