    So now regulations on second-hand smoke = COMMUNISM, what a laugh. I don't see how what's going on over in the UK or Korea is relevant to me or other Americans in any case. Those people and their respective governments are responsible for their own laws, and has nothing to do with us.

    And as for food poisoning, you're wrong again. Without a public health department and government inspections in place, it would take hundreds of cases of food poisoning and deaths before the reputation of a restaurant is affected enough to put it out of business. And even then, the owner could just start up a new business under a different name somewhere else and keep on making people sick.

    You can spew as much verbal diarrhea as you like, but the simple fact is the majority of the public LIKES having clean air and likes the smoking bans, and last I checked we were living in a democracy. In most cities they've been in place and have been working quite well for several years now, and they're not going away. Smokers no longer make the laws, so naturally, the laws are no longer biased in their favor.

  • No it is not flawed read your own constitution. I don't care what a court ruled at one time or some public official thinks, they ignore the boundaries of government whenever the feel like it. As for the public health code how long do you think a restaurant would last with a food poisoning case? It's in their interste not to have such incidents. It's pretty obvious that you are some anto smoking troll cruising for an arguement, a hero hiding behind a keyboard, horray for you!!!

  • What if the employer hires smokers to work in his establishment? The Non smokers always had the option of opening a non smoking bar strip bar if they chose to do so. Non smokers want smoke free areas? Wrong! Anti smokers want smoke free everything. I'm a non smoker and I don't care just as I don't care if someone opens a gay bar.

  • Hmm funny that you opened up by insisting that you are not a statist but you make all the same tired nanny anti smoking arguements. If you hated smoking so much when they allowed it in bars and restaurants why didn't you put up your own money and open up a non smoking restaurant?

    Having a non-smoking section in a restaurant makes as much sense as having a non-peeing section in a swimming pool. Non-smokers want SMOKE-FREE areas. Your strip-bar analogy is also a non-answer. What are non-smokers who don't want the smoke supposed to do if all the bar/restaurant businesses allow it, eat and drink at home? Not to mention, what about the employees? No worker should be forced to choose between his job and his health.

  • If you don't like Italian cooking you don't go to an Italian restaurant. You don't compell the Italian restaurant to stop serving Italian cooking and serve Chinese you go to a Chinese restaurant. Here they have already gone half way to banning smoking in cars if a child is in the car, now in Britain some are advocating banning smoking in cars even if you are alone in a convertable. The line has to be drawn somewhere regarding the state's reach or we might as well live in North Korea.
