I realise that this response is 11 months late, but the legal position with regard to the Lisbon Treaty, the ECHR and the death penalty is not as you describe.
Protocols 6 & 13 to the ECHR prohibit the death penalty in all circumstances. Even should the EU not join these protocols, the ECHR cannot confer such powers on the EU, only the member states can. Also, the Charter of Fundamental Rights, which has equal status to the Treaties, outlaws the death penalty under article 2.

9 - 11 was an inside job, WTC 1 ,2 & 7 destroyed by explosives at the base of the towers, a drone plane with explosive tipped head hit the Pentagon, flight 93 was shot before it reached its target by a fighter jet under the directions of a commander who was not in on the plan.
