Basing Citizenship status of a child solely on the Citizenship status of the Father violates US law. It specifically violates the equal rights amendment of the US Constitution.

In order for any US law to discriminate based on gender one must show that the discrimination is necessary to further a compelling state interest.

What state interest are you suggesting is furthered by discriminating against the mother when it comes to the Citizenship status of the child?
