spider-man isnt owned by the people doing the avengers movie - they sold the rights back when tobey maguire was player peter parker, unfortunately so was the x-men franchise. the avengers under joss whedon is a nerdgasm but a future crossover with the x-men, like they are doing in the comics in the summer, would have been marvel comics nirvana
