San Jose - On Cinco De Mayo 06 Berkeley Copwatcher Jake Gelender was arrested along with other Copwatchers from San Jose after police assaulted a crowd of people. This footage was presented as evidence in defense of Jake Gelender. Gelender is currently on trial on charges of refusal to disperse, and resisting arrest.   • you forget officer that you're not the law of the land, you're just an enforcer and as you know police give unlawful orders, you seem upset, did you become a cop so people would respect you?

  • You right, police officer enforce the law and in this case when told to move or disperse you don't stop and argue. You move! If you have a problem with the order you go threw the proper channels and ask questions after you have complied. I can get respect without a badge or a gun. I treat people with respect and honesty until you cross the line and insist on breaking the law. Thats a decision you make, I didn't make it for you.

  • i beg to differ, as a legal observer, much like reporters copwatch has developed a reputation that sticks, for years copwatchers have put themselves in harms way without guns and vests to document police conduct. the goals of copwatch are to document and not interfere, when you see them, don't be scared. unless you have something to hide. police can kill with impunity and you're worried about non-violent observers? what kind of world are we living in?

  • @wait887 Agreed. What if that wasn't filmed, the cop could have said anything he wanted and their would be no way to challenge it. Police have to be held to a higher standard; they are in a position of authority. We've seen to many instances where police have been filmed and their "sworn" statements are lies because of video evidence. Police cannot be trusted!!

  • @snjbisk. The question is, is the order a lawful order? Just because the cop tells you to cross the street with speeding cars going by and you're surely going to die, and you refuse, are you disobeying a police officer's orders? Observing without interference is allowed under the law. Police must be held accountable for their actions and the only way to ensure they are is for them filmed.

  • @copper2150 I have to agree with Jacob, what's the harm in observing as long as he's not in the way. The law does allow for that, doesn't it? Just because a cop tells you to jump of a cliff, doesn't mean its a lawful order!! A badge doesn't make you any more important than a citizen. Police are given a position of authority, but that authority does come with oversight. Nowhere in that video does he interfere, only observing. The order to move is an illegal one.
