On August 23, 2004, Carolyn Futrell's attorney informed Kayla's family that their baby girl was dead.
Seven year-old Kayla died after consuming a significant amount of poisonous atroban pesticide; approved for pig, sheep, and cattle farms, and only available by prescription..
Toxicology revealed a sedating antidepressant, prescribed to Carolyn Futrell, in Kayla's heart tissue.
Carolyn did not seek medical help until after she called her friend to come over from church; and after she drove to her church, walked in the side entrance, and quietly whispered to the pianist that Kayla was not breathing; and after she drove home. Charlotte did not know CPR. Charlotte testified that she tried to perform CPR while Carolyn drove to the church to get help from the pianist. When the pianist arrived at Futrells home, Charlotte was on the telephone and Carolyn was standing beside her friend,, and the pianist assumed they were calling 911...FINALLY!
Kayla was lying in the middle of the doorway and was cool to the touch. The pianist moved Kayla into the hallway, in order to have room to perform CPR.
First responders described odd behavior for a distraught mother, such as never checking with the ambulance to determine if Kayla had been resuscitated and entertaining people who were coming over. The paramedic moved Kayla from the hallway, to the inside of the ambulance to try to resuscitate her. Kaylas airway was so swollen and red that the paramedic was required to use the smaller size tubing. (This is not mentioned in the Coroners report). Each person present testified that Kayla did not breathe and they were unable to locate a heartbeat.
The "expert" testified it was not possible to determine if Kayla had consumed a lot of the antidepressant several days prior, or if Kayla recently ingested Futrell's antidepressant.
The mist from mixing atroban granules with water, will burn the skin off a grown man's arm" (Dr. Daniel Sudakin, Forensic Toxicologist, medicaltox(dot)org). Safety gloves, masks, and heavy long sleeve's are required when mixing the granules with water, and during use of the liquid atroban. Imagine what such a corrosive pesticide would do to a small, 7 year-old childs lips and mouth, if she had intentionally ingested this smelly pesticide.
Nine months after Kayla was murdered, Carolyn Futrell was arrested on May 20, 2004.
Futrell's recent attempts to have the court suppress the poisoning evidence; the judge refused this request.
I know that why she was in foster care may not be important now...but if parents loved and cherished their children as they should...protecting them and keeping them safe...we wouldn't have such a need for foster care!!! I believe the parents of these victimized children should bear some of the responsibility!

Not in this case. This mother did not do anything wrong. She entrusted her daughter to her brother's care. That is what families do when raised in foster care, she had a child at age 17. At 19, she realized she could not care for her daughter, and asked her brother for help. Her brother's ex wife gained guardianship. Futrell worked for a law firm. Futrell killed Kayla with pesticide poison!

Is it important why?
It is important that she was murdered by Carolyn Futrell of Richlands NC.
Our organization is more concerned about the child and what the child needs, than the reasons they may be in the care of someone other than their own family.
