Luckily, no competent prosecutor will touch that Montana law with a 40-foot pole. Most judges will toss any case out; the only way that law could be enforced would be if SCOTUS reverses itself regarding sodomy laws... which won't happen either.
These laws just stay on the books as an "F U" to minorities. Like Alabama's anti-interracial marriage law, repealed in 2000. Sometimes some bigot brings outdated laws up (like when an atheist was elected in North Carolina), but it never lasts long.

Don't worry - I let all the legislators know I want marriage equality in RI this year. And the SOS VIC page, I had a big part in that when I worked for the SOS.
And Montana, seriously? I can't wait until that one hits the courts.
