    It depends if the supreme court hears the case. in the case of marriage, the supreme court let the states decide the issues and it has been handled thusly. no their claim is baseless in the sense that the "marriage rights" argument isnt documented in the constitution (14th ex). either way, nice talking to you.

    When state issues are suspected of violating any part of the constitution the supreme court typically handles it. And if it was TRULY handled the issue couldn't be raised again. Every time the people who are pushing for gay marriage are allowed an appeal it is due to the nature of their argument. You can't appeal to a higher court if you don't have legit claim. And you didn't have to say baseless, because you are simply dismissing their claim, which means that you feel as if it is not valid. duh

    If that were true there would be no need for the supreme court. It would be an open and shut case or not an issue at all. The fact that the gay community can make such a claim about martial benefits and have a legit case (so much so that it will have to be decided by the supreme court) is proof enough of its validity. Do you really think a baseless claim couldn't be handled by lower courts? And what facts are you using? Everything you've said has been your interpretation; strictly.

    You don't have an argument at all considering the whole marital benefits thing is the basis of the gay marriage movement and it is also the reason why they have an opportunity to address this at the supreme court level. That's just the bottom line. If there was no legitimacy to their claims the courts wouldn't need to address the issue. You can't deny it, that is the primary fact of this case the end. It doesn't matter what YOU PERSONALLY FEEL about the claim, it is indeed legit. P.E.A.C.E. bro

    "military benefits is available to every one" you have to serve first so no it's not available to everyone...that's false.

    "Military benefits go to ANY and EVERYONE who has served " yes but like i said, not everyone can have those benefits. no one who didn't serve can have them...that's the point. The example is relevant because the benefits. like benefits for the handicap or minorities, aren't given to everyone. gays can get benefits as well. they can get military, disabled benefits, etc. Marriage however has been decided as a state issue and the state chooses who gets those benefits. it happens all the time.

    CONT: Its just like heterosexuals who choose not to get married. See the OPPORTUNITY for marital benefits is there. Just like the OPPORTUNITY for military benefits is available to every one (physically able). IF YOU CHOOSE NOT TO GO INTO THE MILITARY IT IS YOUR OWN FAULT THAT YOU DON'T HAVE MILITARY BENEFITS. You made that PERSONAL choice. Now Gay's will have to compromise who they are in order to qualify for marital benefits, because they don't have a CHOICE. Be heterosexual or forfeit marriage

    The flaw in your military example. Military benefits go to ANY and EVERYONE who has served without violating any laws or agreements. Now we both know that is correct. This is where the military example is irrelevant. There's no limitation on who can serve in the military. Therefore EVERYONE can serve if they are physically able correct? The difference is your ABILITY to qualify for certain benefits. Gays don't have the CHOICE to start with. They are automatically disqualified and not by CHOICE!
