You are correct that this is a violation of the 4th ammendment. It is not, however, the fault of the Supreme Court. The wiretapping program has not been reviewed by the Court to my knowledge. And the immunity provision makes it less likely that it ever will (but ACLU is suing now, so we have reason to hope). It is Congress who's to blame for this cave-in, and they're doing it because they're afraid of being "soft on terror." So it is us, "the people," who are guilty by extension.

Being from WI, I can tell you Feingold is one of the best State Representatives in Washington. He has always been on the side of the people. He visits every county in the state once a year to listen to what Wisconsinites have to say. Genuinely a man of the people.
