I'd be pissed too and you can sue if you want, but it's not likely you'll collect anything. If you were able to sue in this instance, can you image the can of worms that would open in other jurisdictions ? His argument in court will be that he "thought" he smelled weed and because he's a sworn officer and because you really can't argue against what he "thought" he smelled, any suit your file will MOST LIKELY be defeated. Credit to you for maintaining your composure.

Sue the bastard. He bases his search on his claim that he smells cannabis. When he finds no cannabis, he obviously didn't smell it, because there was none to smell.
