  • Prop 8 was a horrendous civil rights violation, a bigoted law that should have never been put up for a vote, or even proposed in the first place. The majority has no right to vote on the rights of minorities.

    There's no hypocrisy here. They're overturning a miscarriage of democracy.

  • I was there today. Again the same guy on the defense team was chomping away on gum. Kenneth Miller was a great embarassment for the defense. Boise did not have to do or say much to discredit him. He also practically agreed that there was discrimination towards gays/lesbians. A very weak witness for the Yes on 8. Thompson was visibly nervous as was the rest of his team during the Miller cross-examination.

  • Injustice somewhere is injustice everywhere. Since when was human rights matters put under the "mercy" of the majority vote? The very notion is nauseating.

    Using the same logic of these bigoted, religious-right sickos we could likewise propose another Prop to let the majority vote decide whether all bigots who push hate agendas should be electrocuted.

  • @freakylocz14 I'm afraid your wrong my friend. We have Breyer, Ginsburg, Kagan, and Sotomayor. You have Roberts, Alito, Thomas, and Scalia. Kennedy will be the swing vote on this one.  And based on prior related cases, I think he'll side with Prop 8 being unconstitutional. And as far as the 9th circuit, well I'm certainly not worried there.

  • @microflex22 You better hope you don't go the Supreme Court. The Supreme Court is dominated by conservatives. I hope it goes that far if the 9th Circuit doesn't correct the trial judge's error.

Let's take the mind of a racist, for example: a racist can think that black people are inferior all he pleases. In the confines of his brain, he is well within his rights to think any number of terrible things. It's when he attempts to gain leverage, control, and preferential treatment OVER black people that his processes become a real problem. Same with homophobia.
