The BP spill wakes us up to the importance of accountability at all levels of society. The oil companies continue to insist that they need liability protection. This is a classic example of the entire societies belief that Congress is needed to protect them. In a free market with strict liability each and every oil company and each and every well must be fully liable for any damages that it can impose on others. And the oil companies like everybody else fails to imagine ways that the free market could provide reasonably priced insurance and environmental protections whose cost could be spread by the insurance companies over all of the oil well drillers. Instead the oil companies probably will succeed in maintaining liability caps at unreasonably low levels.
