@kmc8470 in this case it's malicious intent. I guess you'd be ok if a cop were ordered to take a blood sample and he just shot the person to get it? The fact is the cop already had probable cause, since he was administering tests. But his testing methods caused injury, which the cop should be liable for. This drunk guy wouldve easily got his case dismissed with any non-appointed lawer.
