Every lawyer loves to talk about their successes...as they should. They're proud of their wins. Yet nobody talks about the cases they lost. Why not?

It's human nature. Yet a question arises...does the fact that an attorney has lost a case mean that he or she is not a good attorney?

If you are a trial lawyer, you will lose a case at some point in your career. It's inevitable. That's the nature of being a trial lawyer...there are no guarantees when trying a case in court.

  • @californialawyers You are absolutely right. In NY, in an accident, wrongful death or medical malpractice case we seat only 6 jurors and usually two alternates. Nor do we need to have a unanimous verdict on any jury question. We are only required to have 5 out of 6 jurors answer each question.

    This is exactly why I enjoy watching other lawyers on trial. It is important for lawyers to learn not only what TO do, but more importantly, learn what NOT to do by watching others.

  • If you show me an attorney who has never lost a case, I’ll show you a lawyer who hasn’t tried many cases. Losing a case can be devastating. But truth be told, you never know what 12 strangers (I mean jurors) are going to do. I’ve learned more from the cases I’ve lost than the multi-million dollar cases I’ve won. Great video Gerry!
