We won our case. We were told that WE were the people causing the problem during the trial, and have subsequently been harassed for it in town, and even with HUD. So I made this video to show how the downstairs perp has violated other parts of the lease which are supposed to result in eviction, though we don't do the same ourselves.

1. The bags-under HUD, an alcoholic tenant whose behavior impinges on other tenants (like by swearing at, making racial remarks, or threats), is grounds for eviction. The bags are filled with his beer cans.
2. Under the lease, there is not supposed to be any smoking, either, and this has resulted in asthamtic attacks with our kids. The marks on the walls, concrete, and cig butts all give evidence he does this, and he does it inside the apartment also.
3. Storing trash outside-grounds for eviction according to the lease and subsequent papers we originally signed, lookit how he is in violation.
4. Porch swing-creaks in our living room, where we have to sleep due to his noise. No porch swings are allowed according to our lease, we've been offered and asked Blossom twice to put up a swing, but he denied us, and let this troublemaker tenant put up one instead.
5. Stains and general cleanliness-we helped Liz, a drug addict who used to live across from him, clean up her place as Blossom had threatened to evict her. Lookit the stains and general trash-which go as far as the parking lot until Tony cleaned up the beer cans this past Friday. This is grounds for eviction too. He gets away with that, too.

The downstairs tenant has more than enough reasons to be evicted, but it's obvious something else other than BEHAVIOR is coming into play-namely our political beliefs, and our race.

The Management company, based out of Texas, named Alpha Barnes, is lying here too-they are required to keep fire insurance on the complex, and obviously made us and other tenants sign a form stating we would not smoke in the apartment nor cause a fire hazard. The insurance rate they pay is based on that statement being true-but look at it, with that amount of smoking going on they are not holding to contract.
