To add onto what I stated is that hands-free devices do not necessarily make drivers safer. In fact, they may create a false sense of security.

Balderdash. I don't need you people to tell me the laws. I'm fully aware they exist, I just disagree with them. Thumbs down me all you want, I'll ride my bike drunk wearing headphones and talking on my phone even if it kills me.

The California State Vehicle Code describes anything with wheels (motorized or not) that operates on public right of ways as a vehicle, and as such, the vehicle's operator must follow all the same rules as an average car driver would. You can get ticketed for talking on a cell phone on a bike, just like you can get a DUI on a bike...it's the same thing as in a car.

its illegal to be wearing headphones while driving in your car. You can't hear anything around you and you will not be able to hear any sirens of an emergency vehicle warning you of its approach.

In most states a bike has to follow the same traffic laws as cars.
