The Background:
Bankruptcy has been used by solicitors to force clients to pay their disputed bills. Many of thoes made bankrupt are not insolvent, and have refused to pay the solicitors bill on principle. As a result many have lost their homes and businesses.
One problem for someone who is bankrupt is they are not allowed to take anyone, including the solicitor, to court. This means they are unable to challenge the solicitors bill in court.
Another problem is they may have trustees that have been nominated by the solicitors who made them bankrupt.
The Law Society, Legal Complaints Service and the Solicitors Regulation Authority do not prevent bad practice and unprofessional behaviour by solicitors.
