Topic is "What are the rights of the Heirs?" He says NOT many rights? What is he talking about? There are Laws. First he says (Heirs) dont have rights, then he turns around and says (you have a say so). Which is it? Why not say that there is one "Head" person appointed. In preventing confusion. Lawyers tend to lower your expectation, so as to insulate themselves from doing complicating work! and a "Malpractice Lawsuit"
As "Applepeachcat" below stated. I also want to add Lawyers are in business.

THE LAWYERS WILL MAKE SURE THE VICTIM SPENDS AS MUCH MONEY AS POSSIBLE ON LAWYER FEES, AND WILL DO AS MUCH AS THEY CAN DO TO MAKE YOU SETTLE FOR ALOT LESS, AND ALMOST NEVER LET YOU WIN YOUR CASE. FROM WHAT I BEEN THREW WITH MY CASE, I HAVE NO FAITH IN LAWYERS. IT IS SO SAD THAT YOU HAVE NO OTHER CHOICE BECAUSE BY LAW <----LOL......YOU ARE FORCED TO USE THEM, AND YOU HAVE NO OTHER CHOICE.

I HAVE A PROBLEM WITH MY FATHERS ESTATE. AS FAR AS ALL I BEEN THREW WITH THIS PROBATE B/S, IT SEEMS TO ME THAT THEY MAKE THE LAWS SO THE THIEF HAS ALOT MORE RIGHTS, AND THE VICTIM HAS VERY LITTLE RIGHTS. ITS ALL SET UP TO MAKE THE FIGHT LAST AS LONG AS POSSIBLE, AND THAT WAY THE LAWYERS CAN GET MOST OF THE MONEY. I AM SURE IT IS ALSO SET UP SO THE VICTIM GETS MAD, AND MAY TRY TO DO SOMETHING STUPID WHICH INTERN GETS ANOTHER LEGAL MATTER ROLLING.

what if a person has dementia and have given a person a durable power of attorney but the person given this durable power of attorney has listed themselves as a sole beneficiary and there are other children? What rights do heirs have to contest this type of will and if the person was NOT appointed by the court to over-see the affairs of the person who had dementia and passed away?
