Los Angeles Criminal Defense "Super Lawyer" and Board Certified Criminal Law Expert Robert Ernenwein (co-founder of McGregor & Ernenwein Law Offices) explains the dangers of speaking to the police if you are a suspect. The Fifth Amendment protects you against self-incrimination BUT it's not enough to HAVE the right; you must INVOKE it. You have the right to have a lawyer present during your interview.
"I have nothing to say."
"I want to invoke my right to stay silent."
"I wont speak without my lawyer."
These are good examples of things to tell a police officer. However, be mindful of the real-world consequences of being abrasive or rude to a police officer. Your tone and demeanor should not come off as defiant to police authority. You can be assertive but remain polite and still exercise your Fifth Amendment right.

Robert, That is sound advice especially to someone who is a person on interest in a crime . What is your advice to someone who thinks lawyers are more likely to get an innocent man convicted then defending one self.
