100 John Street, New York City - This was the leak in my apartment the day of the trial Feb 2, 2011, when the landlord sued me after I had put my rent money into escrow. The judge yesterday came down in my favor after private discussion with my lawyer, and the landlord yielded before trial. I received an effective 30% abatement, which I had asked for in the second hearing. This is nothing compared to the time I have wasted because of their lack of response, their lack of compunction. I haven't been able to move in to my office. Much of my stuff had to go to storage. Most of the floor panels in my office were wet and buckled for months. Then when they were removed, they were not replaced for months and months. I couldn't use the office. I was patient until August. I filed my first complaint in October.
In the first hearing, the landlord agreed to fix the leak in late November, which they had covered up with plaster without fixing the leak directly above my ceiling, in order to avoid fines in late October because of my complaint Oct 1. I had asked in May 2010 for them to fix the leaking stonework and have an engineer inspect it afterward. They have not done the repair.
The leak began in Mar 2010.
A second leak on the opposite side of this crumbly corner of the building has appeared.
