For the last 2 years I have advocated for people that have been cited by local code enforcement agencies. A preschool in Carmichael was told that their 1200sf building that they have used since 1979 had no permit, so they would have to Move It or Lose It. I went to the County of Sacramento and they said that because the structure was installed before 1982, the County lost all the permits, no permits exist, so the code enforcement inspector would probably win. THAT IS WRONG. Because of my connections with the employees of the Schwartnegger administration, I found that the state had the records all the way back to 1956 and the original plans. What incredible deception for the purpose of revenue generation. To say the least, the 1200sf building is still there; the case is closed. Yet the owner bore the cost of proving his innocence. This happens daily. My goal is to change their common practice. It would be a long process, but the public would benefit from it.

    During budget crunches and crisis, expect creative collusion between building officials to generate the funds that they want for their paychecks.

  • When Code Enforcement action is taken against you in our City of Sacramento, Code Enforcement must send the property owners a preliminary notice to correct the violations with NO fees attached. If the violations are not corrected with in time allowed, only then will cost recovery fees be placed upon the property title. If your property is not a blight to our beautiful community, then you should have nothing to worry about.

    I wish that was the case as you optimistically recommend. I would challenge you to go to an Administrative Hearing, interview the owners, sit through the biased process and come to your own conclusion. Here is how I would ask you to view the proceedings: If your mother was being accused of an infraction in any similar court, would the process used by the City of Sacramento be considered ethical or a violation of civil rights?

  • @sacra948 unless a politician decides you are an undesirable element.i have publicly disagreed with pat brasiel so she has used code enforcement as a weapon. meanwhile leaving her cronies cabinet shop alone.our neighborhood has to listen to the compressor and planers and saws at all hours of the night. but thats how don nottolis office works. scoundrels

  • still there are people that defends the abusive laws of code enforcement. I have just moved to a house in south florida and a NIGHTMARE to deal with this people. The worst thing, if your property had problems before you moved in, doesn't matter, the new homeowner is responsible for all violations done in the past, you are screwed up anyway. The commissioner are there getting your money and YOUR VOTE, YOU ARE VOTING IN THIS PEOPLE TO VIOLATE YOUR RIGHTS. This is happening for all over US.

  • I wish I have watched this video before all nightmare I have had with code enforcement in South Florida. Absolute you are so right, code enforcement is a way to get money from people and they will arise all issues against you and you will always loose because they find a way to link one thing to the other, as a snowball. It is a mafia, it is abusive, extortion, violation of rights, unconstitutional. They come to your house with a detective with guns, treat people like criminal, THANKS ABSOLUTE.

  • @mrbonaparte I agree that many times permits are not necessary. I represented a preschool in Sacramento county where the structural inspector said "There is no record of your modular trailer being installed in 1979; therefore you have installed it without permit." Because of the downtown Sac flood in the late 80s, the building dept uses that as an excuse for double fees. I found the permits, because they keep the pre 80's data elsewhere. This is typical for the city and the county.
