Randy Wallace with Fox 26 News Houston continued the investigative report (linked below)
"You're probably thinking: David and Christina must have done something really awful to their little girl for CPS to spend almost a year trying to terminate their parental rights.
"They actually testified in the first hearing that Rachel was never neglected, never abused and she was a happy healthy child," Rachel's mother Christina said.
Neither parent has been convicted of a felony, so then why is the state agency so hell bent on stripping this couple of their parental rights?
"I went to the hospital to get my appendix out and tested positive for cocaine," Christina said.
When asked, David confirmed he too tested positive for the illegal drug.
Even though CPS has offered no evidence in court that Rachel was ever harmed by her parents' prior drug use, just the fact that they've done drugs is enough for CPS to say they should not be parents.
Why was the couple doing drugs?
"Just recreational use out with friends, holidays, an occasion never did it with Rachel around," David said.
== Child Transforms ==
CPS took custody of Rachel in July 2010.
"At first we didn't see her for 3 or 4 months, they refused visitations," Christina said.
When they finally got supervised visits with Rachel, family members said they couldn't believe their eyes.
You might not either. A picture of Rachel taken 1 week before CPS took custody of her paints a very different picture of Rachel 6 months later.

"When I seen her in foster care it was killing me," Rachel's grandmother Debbie Flores said.

"Every time we would go visit her at visitation she was skinn[i]er and she'd just be lethargic not wanting to move not wanting to say hi just sit in the corner and keep to herself," David said

"She'd be drooling at the mouth her tongue would be hanging out she couldn't focus it was terrible and I'd ask them is she on drugs and they said no," Debbie said.

== CPS Prescribed Drugs ==

But in a January court hearing, CPS admitted the then 3-year-old was put on a number of psychotropic drugs including risperidone, a drug commonly used to treat schizophrenia.

"I think no 3-year-old needs to be on psychotropic drugs. None of them are psychotic," Christina said.

There seems to be a question as to which CPS-contracted doctor prescribed all the drugs and why, according to court transcripts.

Caseworkers have testified they had to place Rachel in various foster homes because she would act up.

She acted up, her parents said, because she wanted to be home with them.

== Judge Frustrated with CPS ==

While most judges seem to just rubber stamp the wishes of CPS, Associate Judge Steven Newhouse is the complete opposite. We were in the courtroom for 2 recent hearings and the judge didn't even try to hide his frustration.

"There's no evidence the child had any behavioral issues before CPS came into her life," Newhouse said in 1 hearing. "As soon as CPS takes her, now she needs help." (Randy Wallace - Fox26News)

  • This is fucking disgusting! I came across this video because I'm a pediatric er nurse and today I discharged a kid home and he was on this psychotropic drug, and he also is 3 years old. I couldn't believe dr's who are people the general public trust are putting our kids on these mind altering drugs! stupid parents take kids to the psychiatrist at 3 years old because they are hyper active... How about they stop feeding them fast food, candy and soda and giving them physical activity and disciplin

From one end of the spectrum -- (1) Apr 15, 2011 – Ten hour siege, a SWAT team... and a TANK: How police dealt with mother who refused to give her child medication.-- to the other.(2) .Parent with joint custody refuses to give prescribed medication ...

    Giving Risperdal to a 3 year-old can only mean the caregiver does not want to get off their duff and teach children through play.

  • @claudioccornejo I know several parents whose children were placed into foster care and immediately medicated with several psychotropics. If the child has a reaction, the docs will not know which of the three psychotropics are at fault.

    This three year-old was on SIX medications!

    I bet Citizens Commission on Human Rights, Austin, want to know the number of children going through the ER, on multiple drugs, esp. young children.

  • @ctrlxxdubssquare39wi Since I know this child well and have cared for her in my home, I believe the only reason for Risperdal was to make the toddler compliant and quiet. She is so full of life and has the energy I wish I had.

    We used Skittles 4 pottying, 1 for using the potty, and another for flushing the potty. She didn't even have an accident for the week. Toddlers are not supposed to be compliant and lethargic, sitting in a corner.

    Skittles work much better and are safer than Risperdal.

  • @daimon7 Absolutely agree parents will grow up and stop doing dumb things. I want to know how CPS obtained the mother's medical records. Her child was with family members and she had an emergency appendectomy. How does that involve CPS?

  • it doesnt make them bad parents .the legall drug alcohol does more damage why put a child on antipsycotics which are very dangerous and they are putting this child in danger .

  • Thank you for posting this news footage. The crimes that CPS agencies worldwide have committed against humanity must be punished. State-sponsored child removal is barbaric and oppressive and must be outlawed at all costs.

  • @hope4kidz Wish when they learned that the baby sitter in my case was the one who was an ex meth head and admitted to wanting children for her own they would of just dropped the case but no they just set me up to fail...thats not telling me what court orders that were left undone information given to them by the psychology report and drug evaluation had said about me and what was expected...just said I refused their advice...I really wish I could get my girls back but I know I can't how can I?
