I think this could have gone either way. The rule includes penalties for *inside the jersey and *inside the pads. If the refs don't believe his hand was inside the jersey, it's not horsecollar. Also, the rule is more for when players are brought immediately *down and *back.
@chubby- know your history before you say things. players have definitely broken legs when tackled using the horsecollar. 2 in one game actually- donovan mcnabb and TO in 2004.

it is a horse collar if the person that got the back of his shoulder pads or jersey grabbed, has his legs buckled and consequently fall on his back. This is a very dangerous way of tackling that has caused injuries, the same reason grabbing the facemask is a penalty if the person being tackeld is spun and falls forwards its not a horse collar.

That was a game that Garcia was actually out with the back injury. There was no choice.
