2nd Circuit Court of Appeals
12/20/2006, C-SPAN Program ID: 195903-1
From C-SPAN's Description:
Oral arguments were heard by the Second Circuit Court of Appeals in the case of Fox Television v. Federal Communications Commission. Fox Television was challenging the FCC's indecency standards and the way it punished broadcasters for airing shows that contain profanity. The network argued that the government violated the First Amendment by embarking on a "radical reinterpretation and expansion" of its power to punish broadcasters for indecent speech. The network contended that the FCC sharply changed its standards for profanity, that the standards were vague and made little sense in the face of industry changes. The FCC fined Fox for language used by Cher and Nicole Richie on the live broadcasts of the 2002 and 2003 Billboard Music Awards, respectively.
@electrictroy2010 I am not talking about news broadcast I do pay for my cable and the only thing the government doesn't censor are the premium channels. I do pay for the news because if i didn't pay for cable i wouldn't have them.

@fuckyou5211 You don't "pay" for broadcast channels like FOX, NBC, CW, et cetera. They are broadcast free-to-air and can be picked-up by anybody. That's why the government censors them (ditto radio)
.
Only cable and satellite channels are uncensored by the government

Why should the government say what i can and cannot watch I pay for the shit. One christian gets offended and we all have to pay. People can be so stupid. If your offended turn your tv off go far away and live under a rock. How much tax money did we waste this time. Right wing fucks.

@striken4pot Brilliant. So you say something as strong as "you make me sick to my stomach" and then can't be bothered to explain why.
If you're going to bother commenting, then perhaps you should take your time to explain yourself properly. Or perhaps you're just another pointless Internet troll.

@ian9outof10 no, a reason that has to do with something other than this case, the fcc, the first amendment, or ur parenting views. But i am not discussing it for the millionth time with the millionth person, forget i said anything...

@striken4pot What, because I think that children shouldn't be allowed uncontrolled access to television. Or that I think adults should be responsible for moderating what their children watch?
In this case, a mistake was made. A channel aired some language in a live TV show. The broadcaster had no control over them and for whatever reason couldn't remove them. It's not like it was premeditated. Censuring them really solves nothing, apart from to placate the dimwits of society.

@ian9outof10 The cuss words were spoken on a unrated LIVE TV awards show. It makes no difference if a TV would have been in the kids rooms or not. They would have heard them in the family room if the kids were watching the live unrated awards show with their parents. That said, I agree kids should not have computers and tvs in the bedroom, but for additional reasons. I believe in preservation of the family unit and values structuring. Meals at the table and family activies in common areas.

Only in america would there be a full court trial because a couple of curse words were spoken on television. Wow.

"Why don't you tell the parents to get those TVs out of bedrooms"
I couldn't agree more. Parents are the people who should control what children watch. This is how my parents ran things, and that's how I'll handle my daughter's TV viewing.
It's not the job of regulators to stop children from hearing bad language. Oh, and kids hear it ALL in the playground anyway. So the whole thing is futile.
