States rights need to be restored, they need to think of their citizens. The law of the State should be the law, period.

I like Andrew Napolitano's argument that the states can enhance liberty but not restrict it. Even Ron Paul does not accept that idea; he says that states should be free to prohibit flag burning, regulate consentual sexual acts, and require everyone to perchase healthcare. Our fundamental rights cannot be abridged by any government, state or federal.

Also, health care is not a right in civilization (civilized society is redundant). Health care is a "RIGHT" in a STATIST society. Health care is a moral obligation for a volunteerist society where people provide care because it is the right thing to do, not because they are mandated by a state that forces it upon them with taxation at the threat of loss of life and property.

The Bill of Rights was only designed to apply to the Federal Government, and they weren't applied to the States until the 14th Amendment. So, I'm confused on where the Judge is coming up with his loony argument on this topic. I usually agree with him on many topics, but I'm sick of people tossing Federalism in the states face. The Constitution was designed to empower and limit the Federal Government to specific powers granted to them by the States.
