It should be this simple. Once your song or script is played over the free airwaves then it's part of the free public domain. Free exchange or peer to peer file swapping is the same as a song on the radio and is really a free ad. Only if money is changing hands for the music then that = infringement. If the CD jacket and photos are copied and put up for sale = Infringement. If anyone thinks or remembers a tune will that be = Infringement? Whistling a popular song will that be =Infringement?
