This is a clip of an MBTA official violating my 1st amendment right to free speech at the Bowdoin T stop in Boston, Massachusetts by stopping me from filming. According to the MBTA policy (as of July 2007 see: http://transitpolice.us/Photo%20Policy/Photo%20Policy%201.pdf ) amateur photography is allowed without a permit She yelled "you can't film in here" (on public property). I informed her it was for personal use and she adamently insisted that no photography was allowed without a permit. I read the ACLU was bringing a suit over this issue.

  • When did you take this video? After july 2007, you were supposed to be allowed to take pictures or videotape on mbta property for your personal use, as long as you had ID on you. They may still have the right to question you, which you would explain and show photo ID, but they can't downright forbid you from photographing or videotaping? What mbta official stopped you? Was it a Customer Service Agent, MBTA inspector, or was it the Transit Police?

  • It took place March 17, 2008, the day I put up the video. I'm not exactly sure what kind of official stopped me...she wasn't providing many details!

  • You thought wrong. Boston has a long tradition of being hostile to railfan photographers, though I hear other places have surpassed it. Mostly its just employees enjoying the feeling of officiousness, management probably cares very little what you do if discreet.

  • haha. in the begining you showed the door. Above the door you can see its high up. kinda like a building train stop. any ways if you walked around to the back theres a big incline i do bmx on it its sweet!

  • It's stupid they have that photo policy. Now amtrak is banning photography on all station platforms and railroad property unless you have a ticket to ride a train that day.

  • I keep a copy of the photo policy in my camera bag. If anyone from the T tells me to stop, I'd pull it out.
