did he commit a crime, somewhat, by the letter of the law yes, but to incarcerate him is stupid, costing taxpayers exponentially more money then he caused in damages to a private company
why not do this...the court orders the man to auction off his artwork, 360$ of the money he gets from it goes to the company, the rest goes to the city, not only that but instead of putting him in jail you give someone a chance to show off his talent and if he gets somewhere can contribute more to society.

Technically he committed the crime, but that's still an awesome barrel thing. If I saw that on the side of the road, it would make my day.

I really love this, but those cones cost alot and they were there for a purpose to protect workers and drivers from accidents. Look at it like this, for drivers to suddenly come up on a humanoid figure leaning towards the road, it could startle them and cause them to swerve and wind up in an accident.
But that being said, just make him pay for the cones and let him promise not to use construction equipment without permission, don't send him to jail!
