Hello, I'm Grant Scheiner, Houston Criminal Defense Attorney.

Every year, thousands of people are arrested in the Greater Houston area for Driving While Intoxicated. Yet only a select few have their cases dismissed. How do they do it?

DWI cases can be successfully defended in many different ways. One way is by challenging the police officer's right to detain you. In some instances, if the police officer didn't see you driving, or if the police officer didn't see you commit a traffic infraction, he may not have had a lawful reason to detain you. And if your attorney can prove in court that the police had no right to stop your vehicle or to detain you, it might lead to a dismissal of the charge against you.

In some cases, the police officer might not have had probable cause to arrest you. This can happen if the police officer doesn't give you any field sobriety tests, or if he gives them to you incorrectly. A surprising number of police officers do not follow the standardized guidelines for administering field sobriety tests. These guidelines are contained in manuals published by the National Highway and Traffic Safety Administration. An experienced DWI attorney should be familiar with these guidelines.

If your attorney can prove in court that the field sobriety tests were insufficient, or that the police officer didn't follow the standardized guidelines, it could lead to a dismissal of the charges against you.
