Oh, never mind, I see that right above this comment someone said it is common for the parties to stipulate that the videotaped deposition can be used at trial. I've never heard of that before, but it answers my question.
With all the edit cuts in this clip it's hard to know what the testimony really amounted to. Did they manipulate anything, or were they using the standard as it existed at the time of the study? It's always easy to claim that the other guy 'manipulated', and you only 'interpreted'.
greg5566: it's fairly common to take a videotaped deposition and stipulate that it can be used at trial instead of having the expert actually attend trial.
