Actually that is not true a blue light and siren does not give the Coast Guard boat the right of way. Boats are not like cars they can just simply get out of the way
How did the coast guard vessil not see the boat infront of them? I would think both of them would have there lights on or be able to communicate with each other.

More precisely, how did the people on the boat not realize what a COAST GUARD vessel was, or what a blue light on a boat meant?
If the crew had the siren active as well as the light, then the civilian is at fault, and should be charged with negligent homicide.
