  • I never watched the video in question in full, so I have no real idea of just what was said. Nor do I know BK's history. I'm just not that interested in that type of drama, rumors, accusations, or anything that doesn't affect me directly. Whether or not BK was defamed or not, is something the courts would have to decide, not me. People on the net can infer, claim, or insist, anything they want to, but without exact, verifiable evidence, I don't believe anything anyone says. Nobody should.

    Brett filled the DMCA on straightd0pe's only video about him. I don't think that a single video can be viewed as harassment, I think it would take at least three. Defamation would require a "false" or "unjustified" attack on the character of a person. This, also, would not be the case in regard to straighd0pe's video.

  • The cyber bullying law , now under consideration in congress H.R.1966, covers far more than just children, as do many of the anti-cyberharassment laws already on the books.

    I feel I must address another point you made a couple of comments ago about copyrighted material. If someone uses my content, for instance dubbing in their own audio or text, over my video. They have possibly used that content, to break the law, by harassing or defaming me. This may violate fair use, but has not been tested.

  • Cyber bullying laws only protect children. Last I checked, Brett was a fully grown adult.

  • I'm not at all confused by the difference between a civil and a criminal case, perhaps you are. In many jurisdictions, both defamation and harassment are criminal acts. Fair use does not cover these acts, and neither does fair use cover the further use of any material adjudicated as harassment or defamation in a civil case. This is one of the reasons that congress here in America, is attempting to pass a cyber bullying bill...to make these criminal laws universal in the states.

  • You appear to be confused in the difference between a civil and a legal case. DMCA is entirely and unequivocally about copyright. If a DMCA charge is filed against a work that contains no copyrightable material, or what copyrightable material therein falls under fair use, the charge is false, and the filer has perjured eirself.

    Defamation and harassment are civil, not legal matters.

  • First off, I though you were talking about dropping docs. Second, a judge has to rule on the legitimacy of the DMCA filed, before it could possibly be deemed a false filing. Third, case law has not been tested, to my knowledge, in filing DMCAs that counter harassment or defamation, which are crimes themselves. Fourth, any filing filed in good faith of a favorable ruling, is not considered a false filing. The only way your argument could stand, is if in the end, none of these criteria are met.

  • The DMCA is federal law. To falsify information on a legal document is perjury. Perjury is an obstruction of justice, and a crime.

  • Federal crime?? What federal crime?? Please cite statute and source.
