@theskyisbreaking In real life you're right. They probably wouldn't be able to fire her like this. But by this time, Syd had basically run her course as the receptionist/manager of Peter & MIchael's medical practice and there was little else she could do there. Plus the writers had other plans for her character. So they had to have a way to get her fired from this job, and this was the first thing they could probably think of.

@javierbourne In fact the way they got rid of Syd may be illegal itself, considering Sydney was a partner along with Peter and Michael, I'm sure you can throw another parner out like this
