Actually Youtube owns the site,and do not charge it's users for the service,they may use any consistant policy they deem to determine censorship of information that is not consistant to their policies.

From what I can tell, Youtube is not always consistent in the way they enforce their policy. Also, they claim they are the "Largest Town Hall" in the world. They can legally censor anyone they like, but as stewards of the largest town hall they do have a moral obligation not to suspend people without damn good reason and to have a system for appealing their decisions set up when they make a mistake.

As far as I've heard, YouTube can't actually do anything to confirm or refute DMCA claims. They're required to take down the "offending" content regardless of the accuracy. But then again, IANAL.
