The Answer - as so often in Law - "it all depends..."
It all depends... "On what exactly?"
"The circumstances of the case!"
And that is where a good Defence can make all the difference...!

In this LAW lecture, various scenarios are put to us - in relation to MANSLAUGHTER/ MURDER
The Actus Reus - i.e. the Physical act
The Mens Rea - i.e. the Intent /Intention

We need to explore the evidence of a perpetrator of an act that has/had potentialy criminal consequences in order to decipher where along the scale of things does the conduct lie...

An excellent tool at looking at potential scenarios is to consider various hypothetical situations...

What do the students think - but more importantly - what is their Legal Reasoning?

This is an exercise in Jurispridence [i.e. the Philosophy of Law & Legal Reasoning & Legal Philosophers...such as Jeremy Bentham (UCL, London - the oldest College of London University - Bentham House = the Law faculty of UCL)]

[Note that far too many Judges are Freemasons who have sworn a PRIVATE Oath to go to the aid of Masonic Brethren that assert they are (purportedly) "In Distress" - that can help explain many of the apparently perverse decisions that are known to the law of most Western jurisdictions - certainly most perverse Commonwealth decisions].

Are you FREE to choose?
Sandel introduces the libertarian concept of individual rights, whereby only a minimal state is justified. Libertarians argue that government should not have the power to enact laws that i) protect people from themselves, such as smoking &/or seat belt laws, ii) impose some person's moral values on society as a whole, oriii) redistribute income from the wealthy to the less well off. The lecturer explains the libertarian notion that redistributive taxation is similar to forced labour with references to Bill Gates and Michael Jordan [the alternative enables individuals with vast assets to ensure there are no obscene differences without some form of redistributive tax system].

In the US, some of the founding fathers & several subsequent leaders expressed opposition to redistribution of wealth. Samuel ADAMS stated: "The utopian schemes of leveling [redistribution of wealth], and a community of goods, are as visionary and impracticable as those that vest all property in the Crown. [These ideas] are arbitrary, despotic, and, in our government, unconstitutional." James MADISON, author of the US Constitution, wrote, "I cannot undertake to lay my finger on that article of the Constitution which granted a right to Congress of expending, on objects of benevolence, the money of their constituents."

  • Do YOU think you might not be intelligent enough to attend LAW school?

    Some of the students that attend Harvard are particularly stupid... [based on their answers re 911 - they demonstrate their lack of analytical skills by automatically accepting the mainstream media opinions without more - they would not make very good lawyers that must look carefully at ALL the AVAILABLE evidence - much is on the Internet to be followed up].

    What are the challenging factors?

    Cost considerations?

    LOANS?
